1. Agreement to Terms

By accessing or using AI Rank ("Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by LOON SHOOT PTY LTD (ABN 85 638 743 932) ("we", "us", or "our"), a company based in Victoria, Australia. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

AI Rank provides brand monitoring and analytics services that track how artificial intelligence language models (LLMs) represent and mention your brand. Our Service includes:

  • Monitoring brand mentions across multiple LLM providers (ChatGPT, Claude, Gemini, and others)
  • Sentiment analysis and tracking of AI-generated content about your brand
  • Competitor monitoring and market positioning insights
  • Content strategy recommendations based on AI representation data
  • Dashboard and analytics tools for tracking brand performance in AI contexts

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any laws
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the Service or servers
  • Use automated means to access the Service without our express permission
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Monitor competitor data for purposes of competitive intelligence gathering on behalf of third parties without proper authorization

5. Data Collection and Usage

We collect and analyze data from various LLM providers to provide our Service. By using AI Rank, you acknowledge that:

  • We query LLM providers on your behalf to gather brand mention data
  • The data provided is based on AI-generated responses and may not always be accurate
  • We aggregate and analyze this data to provide insights and recommendations
  • You are responsible for how you use the insights provided by our Service

6. Intellectual Property

The Service and its original content, features, and functionality are owned by AI Rank and are protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your business purposes.

7. Subscriptions and Payment

Some aspects of the Service may be provided for a fee. You agree to:

  • Provide accurate and complete billing information
  • Pay all fees associated with your subscription plan
  • Accept that subscriptions automatically renew unless cancelled
  • Understand that fees are non-refundable except as required by law

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that:

  • The Service will be uninterrupted, secure, or error-free
  • The data and insights provided will be accurate or complete
  • LLM provider responses will remain consistent over time
  • The Service will meet your specific requirements

9. Limitation of Liability

To the maximum extent permitted by Australian law, AI Rank shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless AI Rank and its affiliates from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

14. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.
